1. Acceptance of Terms

By accessing or using Facede ("the Service"), available at facede.ai, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Facede provides AI-powered video generation services that allow users to:

  • Upload facial photographs for AI video generation
  • Apply AI face processing filters
  • Generate AI videos using various models (Seedance, VEO, Wan)
  • Access pre-built video templates
  • Download and use generated video content

3. Account Registration

  • You must create an account to use the Service
  • You must be at least 18 years old
  • You are responsible for maintaining the security of your account
  • You must provide accurate and complete information
  • One account per person; shared accounts are not permitted

4. Payments & Pricing

4.1 Pay-Per-Use

Individual video generations are charged at the price displayed at the time of purchase. Prices range from $0.49 to $4.99 per video depending on the AI model selected.

4.2 Subscription Plans

Monthly subscription plans include a set number of video generations. Unused credits do not roll over to the next billing period.

4.3 Refunds

Due to the nature of AI generation (compute costs are incurred immediately), refunds are generally not available for successfully generated videos. If a video generation fails, you will not be charged, or a credit will be applied to your account. For subscription refund requests, please contact hello@facede.ai within 7 days of purchase.

4.4 Payment Processing

All payments are processed securely by Stripe. We do not store your credit card information.

5. Acceptable Use

You agree NOT to use the Service to:

  • Generate content depicting minors in any inappropriate context
  • Create deepfake content intended to deceive, harass, or defraud others
  • Generate content that impersonates real people without their consent
  • Produce sexually explicit, violent, or illegal content
  • Create content that violates intellectual property rights
  • Use the service for political disinformation or propaganda
  • Attempt to reverse-engineer or bypass security measures
  • Resell or redistribute the Service without authorization

Violation of these terms may result in immediate account termination without refund.

6. Content Ownership & Licensing

6.1 Your Content

You retain ownership of the photos you upload. By uploading content, you grant Facede a limited, non-exclusive license to process the content solely for the purpose of providing the Service.

6.2 Generated Content

You own the videos generated through the Service. You may use generated content for personal and commercial purposes, including social media, advertising, and e-commerce. You are solely responsible for the content you create and how you use it.

6.3 Facede Branding

Generated videos may contain a subtle Facede watermark on free or lower-tier plans. Premium plans include watermark-free output.

7. AI-Generated Content Disclaimer

AI-generated videos may not perfectly replicate real-world scenarios. Results depend on input quality, prompt specificity, and AI model capabilities. We do not guarantee specific outcomes. You acknowledge that:

  • AI outputs may vary between generations
  • Face consistency across videos is not guaranteed
  • Generated content should be reviewed before public use
  • You are responsible for ensuring generated content complies with applicable laws

8. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, Facede shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Facede, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Generated content that has been downloaded remains yours.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from these Terms shall be resolved in the courts of Istanbul, Turkey.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or prominent notice on the Service. Continued use after changes constitutes acceptance of the modified Terms.

14. User Content Responsibility (binding clause)

You are solely and fully responsible for any content you generate, upload, share, or distribute through the Service. By using the Service you irrevocably acknowledge that:

  • You hold all necessary rights, licenses, consents and permissions for any photo or likeness you upload, including the rights of any third person whose face or voice appears in your inputs.
  • You will not use the Service to create content that violates Turkish or international law, including content that infringes personality rights, copyright, trademarks, or honor; content depicting minors inappropriately; non-consensual intimate imagery; misleading or fraudulent content; or content promoting hate speech, terrorism, or violence.
  • Facede operates as a technical service provider and exercises no editorial control over user-generated content. All civil, financial, and criminal liability arising from generated content rests exclusively with the generating user.
  • Facede may suspend or terminate any account upon a credible report of violation, may withhold refunds, and may share account data and generated content with competent authorities upon lawful request.
  • This responsibility persists after account termination and applies to content already created.

A record of your acceptance. including version, timestamp, anonymized IP, and user-agent. is stored in user_consents for evidentiary purposes per KVKK Article 5(2)(f).

15. Türkçe Özet. Kullanım Koşulları (Bağlayıcı)

FaceDe'yi kullanırken aşağıdaki maddeleri kabul ettiğinizi beyan edersiniz:

  • İçerik sorumluluğu: Yüklediğiniz fotoğraflardan ve oluşturduğunuz tüm video/görsel içerikten münhasıran ve tamamen siz sorumlusunuz. FaceDe yalnızca teknik altyapı sağlar.
  • Üçüncü kişiler: Başka birinin yüzünü/sesini yalnızca o kişinin açık ve aydınlatılmış izni ile kullanabilirsiniz; aksi halde TCK 134 (özel hayatın gizliliği), 6698 sayılı KVKK ve TBK 49 (haksız fiil) hükümleri uyarınca tüm sorumluluk size aittir.
  • Yasak içerik: Çocukları uygunsuz tasvir eden, müstehcen, nefret söylemi içeren, terör/şiddet öven, yanıltıcı, kişilik hakkı veya fikri mülkiyet ihlal eden içerik üretmeyeceksiniz.
  • İhlal sonucu: İhlal tespitinde hesabınız iade yapılmaksızın kapatılır, içerik silinir ve hukuki süreç başlatılır; talep halinde içerik yetkili makamlarla paylaşılır.
  • Onay kaydı: Bu koşulları kabul ettiğiniz an; tarih, sürüm, anonimleştirilmiş IP ve cihaz bilgisi user_consents tablosunda KVKK m. 5/2-f kapsamında ispat amacıyla tutulur.
  • Yetkili mahkeme: İstanbul Anadolu Mahkemeleri ve İcra Daireleri.
